Billionaire Oracle chief Larry Ellison has just listed his Lake Tahoe mansion in Glenbrook, Nev., for a whopping $28.5 million. No surprise to us, really, considering that he's built another mega-mansion on the other side of the lake, which he's just about ready to move into, according to our friends at Curbed.

If the new mansion's anything like the one that he's just thrown on the market, then we want in! It boasts 230 feet of lake frontage with its own white sand beach and private harbor. And that beachfront cabana with sundeck just sweetens the deal! Yes, owning your own Hawaiian island just isn't enough for some members of the 1 percent. Oh, you haven't forgotten that Ellison bought 98 percent of the Hawaiian island of Lanai, have you? And then bought a freakin' airline to get him to and fro?!

He'll keep that while you settle for his measly 14,192-square-foot mansion. Altogether, Ellison's just-listed Lake Tahoe property boasts 13 bedrooms and 13 bathrooms. Maybe its movie theater, library and sauna will also entice you. But, yeah, it's no Hawaiian island.

Samsung Exynos Octa now rocking LTE, destined to Korean market

When Samsung's Exynos 5 Octa was announced, it was believed to be compatible with 3G networks only. As such, the HSPA+ (global) version of the Galaxy S 4 was the only handset to feature the company's eight-core SoC -- the LTE model shipping with Qualcomm's 4G-capable, quad-core Snapdragon 600 instead. That's apparently changed, with the Korean giant tweeting that the Exynos 5 Octa now supports LTE on 20 bands. So why even make a Snapdragon 600 version of the Galaxy S 4, then? Perhaps Samsung can't produce as many chips as Qualcomm to meet the upcoming worldwide demand for its new flagship. This appears likely, with inews24 and new-samsunggalaxys4 reporting that the Exynos 5 Octa with LTE is currently reserved for Korean models only (SHV-E300S, SHV-E300K and SHV-E300L, to be exact). So, anyone fancy a trip to Seoul in the near future?

Bosnia: Man sentenced to 45 years for war crimes

SARAJEVO, Bosnia-Herzegovina (AP) ? A court in Bosnia on Friday convicted a Montenegrin man of multiple counts of murder, torture, rape and looting during Bosnia's 1992-95 war, and sentenced him to 45 years in prison ? the highest sentence ever issued in the country.

Judge Zoran Bozic said that Veselin Vlahovic, killed 31 people, raped a number of Bosniak and Croat women and tortured and robbed non-Serb residents of a Sarajevo suburb while fighting for the Bosnian Serbs. Among other crimes, the judge described how Vlahovic cut the throats of two brothers in front of their mother, then killed her and raped the men's wives.

"We are happy with the maximum sentence," said Boris Grubisic, the spokesman for the Prosecutor's office.

He said that during the trial some of the 112 witnesses described the rape of women late in their pregnancies and mothers being raped in front of their children. Grubisic said that Vlahovic committed the crimes over several months. Although he received the maximum sentence, the prosecution still plans to appeal because he was acquitted on six counts.

Vlahovic's layer Radivoje Lazarevic said he also will appeal the sentence because he believes that some of the 60 counts on which Vlahovic was convicted were not proven.

In 1992, when Bosnian Serb forces laid siege to Sarajevo, they mistreated non-Serb residents of the areas that they controlled. Vlahovic was the commander of a paramilitary unit that went from house to house looking for Muslims and Catholics, then looted their homes, tortured and often killed entire families.

Vlahovic, 43, appeared occasionally bored as the judge spent two hours reading horrific details from the verdict.

He said that in most cases, Vlahovic and his gang entered people's apartments, asked for money and gold, promising not to kill in return ? a promise they often didn't keep.

After the robbery, women were raped and men beaten and tortured. Some were killed on the spot or driven off in a car after, never to be seen again.

In some cases Vlahovic asked victims to kiss the hand that was beating them. He took one man to a house and ordered him to have sex with the body of a woman whose throat had been cut, the judge said.

"Everything was followed by extremely arrogant and brutal behavior, which led the witnesses to remember him as the Monster of Grbavica," judge Bozic said.

Vlahovic showed no reaction when the judge pronounced the verdict.

Bakira Hasecic, the head of an association of victims of wartime rape, said the sentence was the best satisfaction that has so far come out of Bosnia's war crimes court, but added that Vlahovic was such a monster that even the maximum sentence was not enough for him.

Vlahovic fled to neighboring Serbia and Montenegro after the war. He was jailed in Montenegro for armed robbery but escaped from prison. Spanish police then found him in 2010 living in the town of Altea. He was extradited to Bosnia the same year although he is also wanted in Spain for robbery and assault with a firearm.

The war crimes department of the Bosnian State Court was established in 2005 to take some of the burden from the overcrowded U.N. International Criminal Tribunal for former Yugoslavia, based in The Hague.

Foreign and domestic judges and prosecutors have processed about 100 cases of war crimes, including genocide, in accordance with international standards and under the monitoring of the Organization for Security and Cooperation in Europe.

Amid a major judges overhaul for season three of "The X Factor," there will be at least two familiar faces looking back at the contestants -- one of them smiling.

In addition to "X Factor" mastermind Simon Cowell, Demi Lovato will be back in a judge's chair for the third season of the Fox series.

The pop singer, who joined the singing competition in its second season, was the youngest judge on the show and mentor to the Young Adults category.

"I am so excited to return as a judge and mentor on 'The X Factor,'" said Lovato. "Last season was an unbelievable experience and I really enjoyed developing personal relationships with the contestants and the panel. I look forward to taking my previous experience and applying it to make this season even better."

Season three of "X Factor" began the first round of auditions on March 6 in Los Angeles. So far, replacements have not been named for exiting judges L.A. Open auditions for season three continue in New Orleans on April 14, followed by Long Island, N.Y., on April 25 and Denver, Colo., on May 14.

"I couldn?t be happier that Demi wants to come back this year," said executive producer Cowell in a statement. "She?s a superstar in her own right and was a fantastic mentor last year. Lovato has had a busy 2013 already. The first single off her currently untitled fourth studio album, "Heart Attack," debuted at No. 1 on the iTunes chart in 18 countries (including the U.S.) and No. 12 on the Billboard Hot 100 chart (the second-best Billboard debut of the year).

Earlier this month, during an appearance on Ryan Seacrest's radio show, Cowell confessed that he hoped Lovato would return to the series. "We?d be crazy not to have her back," he said, adding that "I liked having Demi on the show" and that "she?s fun to work with."

Even graphene has weak spots

Mar. 28, 2013 ? Graphene, the single-atom-thick form of carbon, has become famous for its extraordinary strength. But less-than-perfect sheets of the material show unexpected weakness, according to researchers at Rice University in Houston and Tsinghua University in Beijing.

The kryptonite to this Superman of materials is in the form of a seven-atom ring that inevitably occurs at the junctions of grain boundaries in graphene, where the regular array of hexagonal units is interrupted. At these points, under tension, polycrystalline graphene has about half the strength of pristine samples of the material.

Calculations by the Rice team of theoretical physicist Boris Yakobson and his colleagues in China were reported this month in the American Chemical Society journal Nano Letters. They could be important to materials scientists using graphene in applications where its intrinsic strength is a key feature, like composite materials and stretchable or flexible electronics.

Graphene sheets grown in a lab, often via chemical vapor deposition, are almost neverperfect arrays of hexagons, Yakobson said. Domains of graphene that start to grow on a substrate are not necessarily lined up with each other, and when these islands merge, they look like quilts, with patterns going in every direction.

The lines in polycrystalline sheets are called grain boundaries, and the atoms at these boundaries are occasionally forced to change the way they bond by the unbreakable rules of topology. Most common of the "defects" in graphene formation studied by Yakobson's group are adjacent five- and seven-atom rings that are a little weaker than the hexagons around them.

The team calculated that the particular seven-atom rings found at junctions of three islands are the weakest points, where cracks are most likely to form. These are the end points of grain boundaries between the islands and are ongoing trouble spots, the researchers found.

"In the past, people studying what happens at the grain boundary looked at it as an infinite line," Yakobson said. "It's simpler that way, computationally and conceptually, because they could just look at a single segment and have it represent the whole."

But in the real world, he said, "these lines form a network. Graphene is usually a quilt made from many pieces. I thought we should test the junctions."

They determined through molecular dynamics simulation and "good old mathematical analysis" that in a graphene quilt, the grain boundaries act like levers that amplify the tension (through a dislocation pileup) and concentrate it at the defect either where the three domains meet or where a grain boundary between two domains ends. "The details are complicated but, basically, the longer the lever, the greater the amplification on the weakest point," Yakobson said. "The force is concentrated there, and that's where it starts breaking."

"Force on these junctions starts the cracks, and they propagate like cracks in a windshield," said Vasilii Artyukhov, a postdoctoral researcher at Rice and co-author of the paper. "In metals, cracks stop eventually because they become blunt as they propagate. But in brittle materials, that doesn't happen. And graphene is a brittle material, so a crack might go a really long way."

Yakobson said that conceptually, the calculations show what metallurgists recognize as the Hall-Petch Effect, a measure of the strength of crystalline materials with similar grain boundaries. "It's one of the pillars of large-scale material mechanics," he said. "For graphene, we call this a pseudo Hall-Petch, because the effect is very similar even though the mechanism is very different.

"Any defect, of course, does something to the material," Yakobson said. "But this finding is important because you cannot avoid the effect in polycrystalline graphene. It's also ironic, because polycrystals are often considered when larger domains are needed. We show that as it gets larger, it gets weaker.

"If you need a patch of graphene for mechanical performance, you'd better go for perfect monocrystals or graphene with rather small domains that reduce the stress concentration."

Co-authors of the paper are graduate student Zhigong Song and his adviser, Zhiping Xu, an associate professor of engineering mechanics at Tsinghua. Xu is a former researcher in Yakobson's group at Rice. Yakobson is Rice's Karl F. Hasselmann Professor of Mechanical Engineering and Materials Science and professor of chemistry.

GOP tries to zap technology gap with Democrats

WASHINGTON (AP) ? Embarrassed by how the last presidential election exposed their yesteryear technology, Republicans are turning to a younger generation of tech-savvy social media experts and software designers to improve communications with voters, predict their behavior and track opponents more vigorously.

After watching President Barack Obama win re-election with help from a technology operation unprecedented in its sophistication, GOP officials concede an urgent need for catch up.

"I think everybody realized that the party is really far behind at the moment and they're doing everything within their realistic sphere of influence to catch up," said Bret Jacobson, a partner with Red Edge, a Virginia-based digital advocacy firm that represents the Republican Governors Association, the U.S. Chamber of Commerce and the Heritage Foundation.

Democrats began using related technology years ago, giving Obama a significant advantage last fall in customizing personalized fundraising and get-out-the-vote appeals to prospective supporters. With the blessing of party leaders, a new crop of Republican-backed outside groups is developing tools to do the same in 2014 and 2016.

Alex Skatell, former digital director for the GOP's gubernatorial and Senate campaign operations, leads one new group that has been quietly testing a system that would allow Republicans to share details about millions of voters ? their personal interests, group affiliations and even where they went to school.

With no primary opponent last year, Obama's re-election team used the extra time to build a large campaign operation melding a grass-roots army of 2.2 million volunteers with groundbreaking technology to target voters. They tapped about 17 million email subscribers to raise nearly $700 million online.

Data-driven analytics enabled the campaign to run daily simulations to handicap battleground states, analyze demographic trends and test alternatives for reaching voters online.

Republican presidential nominee Mitt Romney, in contrast, had only a few months after a lengthy primary fight to try to match Obama's tech advantage. He couldn't make up the difference. Romney's technology operation was overwhelmed by the intense flow of data and temporarily crashed on Election Day.

A 100-page report on how to rebound from the 2012 election, released last week by Republican Party Chairman Reince Priebus, includes several technology recommendations.

"The president's campaign significantly changed the makeup of the national electorate and identified, persuaded and turned out low-propensity voters by unleashing a barrage of human and technological resources previously unseen in a presidential contest," the report said. "Marrying grass-roots politics with technology and analytics, they successfully contacted, persuaded and turned out their margin of victory. There are many lessons to be learned from their efforts, particularly with respect to voter contact."

Skatell, 26, is leading one new effort by Republican allies to fill the void. His team of designers, software developers and veteran Republican strategists is now testing what he calls an "almost an eHarmony for matching volunteers with persuadable voters" that would let campaigns across the country share details in real time on voter preferences, harnessing social media like Facebook and Twitter.

Other groups are working to improve the GOP's data and digital performance.

The major Republican ally, American Crossroads, which spent a combined $175 million on the last election with its sister organization, hosted private meetings last month focused on data and technology. Drawing from technology experts in Silicon Valley, the organization helped craft a series of recommendations expected to be rolled out later this year.

"A good action plan that fixes our deficiencies and identifies new opportunities can help us regain our advantage within a cycle or two," said Crossroads spokesman Jonathan Collegio.

A prominent group of Republican aides has also formed America Rising, a company that will have a companion "super" political action committee that can raise unlimited contributions without having to disclose its donors. Its purpose is to counter Democratic opposition research groups, which generated negative coverage of Romney and GOP candidates last year.

America Rising will provide video tracking, opposition research and rapid response for campaign committees, super PACs and individual candidates' campaigns but does not plan to get involved in GOP primaries. It will be led by Matt Rhoades, who served as Romney's campaign manager, and Joe Pounder, the research director for the Republican National Committee. Running its super PAC will be Tim Miller, a former RNC aide and spokesman for former GOP presidential candidate Jon Huntsman.

Romney and several Republican candidates were monitored closely by camera-toting Democratic aides during the campaign, a gap that Miller said American Rising hopes to fill on behalf of Republicans.

Brad Woodhouse, a spokesman for the Democratic National Committee, said his party has "a several years' lead on data and analytics infrastructure and we're not standing still."

Of the GOP effort, Woodhouse said, "We don't see them closing the gap anytime soon."

Sprial galaxy: Hidden depths of Messier 77 revealed

Mar. 28, 2013 ? Messier 77 is a galaxy in the constellation of Cetus, some 45 million light-years away from us. Also known as NGC 1068, it is one of the most famous and well-studied galaxies. It is a real star among galaxies, with more papers written about it than many other galaxies put together.

Despite its current fame and striking swirling appearance, the galaxy has been a victim of mistaken identity a couple of times; when it was initially discovered in 1780, the distinction between gas clouds and galaxies was not known, causing finder Pierre Mechain to miss its true nature and label it as a nebula. It was misclassified again when it was subsequently listed in the Messier Catalogue as a star cluster.

Now, however, it is firmly categorised as a barred spiral galaxy, with loosely wound arms and a relatively small central bulge. It is the closest and brightest example of a particular class of galaxies known as Seyfert galaxies -- galaxies that are full of hot, highly ionised gas that glows brightly, emitting intense radiation.

Strong radiation like this is known to come from the heart of Messier 77 -- caused by a very active black hole that is around 15 million times the mass of our Sun. Material is dragged towards this black hole and circles around it, heating up and glowing strongly. This region of a galaxy alone, although comparatively small, can be tens of thousands of times brighter than a typical galaxy.

Although no competition for the intense centre, Messier 77's spiral arms are also very bright regions. Dotted along each arm are knotty red clumps -- a signal that new stars are forming. These baby stars shine strongly, ionising nearby gas which then glows a deep red colour as seen in the image above. The dust lanes stretching across this image appear as a rusty, brown-red colour due to a phenomenon known as reddening; the dust absorbs more blue light than red light, enhancing its apparent redness.

New Audi A3 Sedan and hot 300 hp S3 Sedan unveiled

Audi A3 Limousine

This is a car whose arrival we saw from a mile away. Previewed twice in 2011 (here and here) and again last week, the Audi A3 Sedan has finally broken cover ahead of the New York Motor Show before being given its public debut in Shanghai next month.

What came as a surprise is the joint unveiling of the S3 Sedan alongside the standard models. Now, Audi has never been shy of stretching out its car launches to multiple motor shows: the third-generation A3 was first shown in three-door form at Geneva last year, followed by the A3 Sportback and S3 in Paris six month later, while we had to wait till this year to see the S3 Sportback.

Offered in a booted form for the first time, the A3 Sedan follows the four-door coupe formula rather than a traditional three-box sedan. The boot is kept short, with the cabin glasshouse stretched backwards to enhance the visual effect. The wheel arches have been widened too, making it appear lower to the ground and more planted.

Audi A3 Limousine

It is 150 mm longer, 11 mm wider but 9 mm lower than the A3 Sportback, with a long 2640 mm wheelbase and short overhangs. The designers are particularly proud of the ?tornado line? element across the car, a light-refracting edge that hides the visual bulk of the car?s rear end. It hides its hatchback roots rather well, despite having a high boot line.

The front end of the car gets a unique bumper with wider slats and more horizontal elements. Full LED headlights are an option. Round the back, the bootlid acts as a rear spoiler, whole the tapered rear lamps are designed to make the A3 Sedan appear lower and more athletic. It sits on the latest MQB platform, and with the smallest engine fitted (1.4 TFSI), weights just 1,250 kg.

Other than updated interior graphics, the dashboard is carried over whole from its hatchback siblings. The seating accommodation is identical to that of the five-door Sportback, but the Sedan has a bigger cargo area with the seats up.

Audi S3 Limousine

Three engine choices are available from the get go: 1.4 TFSI with COD (cylinder on demand) making 140 hp/250 Nm, 1.8 TFSI with 180 hp and 250Nm, plus a 150 hp/320Nm 2.0 TDI, all mated to either a six-speed manual or dual-clutch S-tronic transmission. 0-100 km/h figure for each model is 8.4, 7.3 and 8.7 seconds respectively.

The S3 Sedan on the other hand uses the same 2.0 TFSI engine with 300 hp and 380 Nm found in other S3 models with a quattro all-wheel drive system. With the optional S-tronic ?box it dips below five seconds for the 0-100 km/h sprint. It takes 0.4 seconds longer (5.3 seconds) with a manual transmission. Top speed, as usual, is limited to 250 km/h.

Mechanical differentiators include 25 mm lower ride height with sports suspension, beefier brakes and variable-ratio electric power steering. Visually, the top model is distinguished by modifications to the bumpers, the singleframe grille, air intakes, side sills and rear spoiler. S-model hallmark such as the four tailpipes and silver exterior mirror housings are present too.

What to Wear to a Music Festival Pt I - the skinnyblondegirl blog ...


Music festival season isn't here quite?yet, but that doesn't mean you can't start planning your summer must-haves and music festival ensembles. At any music festival, you want to look stylish, remain comfortable, and not go over-the-top. In this post I'm showing you the first of many music festival style posts I'll be doing over the next few months. This time I'm focusing on a classic outdoor festival, whether it is folk music, indie music, or whatever else. This is the sort of outfit I'd wear to Coachella, Osheaga, or Lollapalooza.

To me, the fundamentals of a good festival outfit are the sunglasses and shoes. For sunglasses, I opted for a pair of Michael Kors Sunglasses uk from www.shadesoftime.co.uk. Proper sun protection for your eyes is crucial all year round, and even more when you're standing under the hot sun all day long dancing to songs by your favourite bands. For the shoes, I went with a flat pair of leather sandals (with ankle strap) from Aldo Shoes. The reason I chose these ones is because a) they're on sale and b) they're not flip flops. An unfortunate part of going to any concert is that your feet get stepped on a hundred times throughout the day. For this reason, you should avoid flip flops since they're basically an open invitation to get stepped on, plus if you're like me they're way too easy to trip while wearing (sigh).

I love this tank top from Topshop because of its geometric meets tribal print and interesting back. You could wear a bathing suit top underneath or a bandeau and be festival-ready in no time. If you're going to wear a traditional bra, I'd recommend getting something with convertible straps and wearing it as a halter. That way you still get support and all that goodness without showing straps and ruining the adorable back of the top. I'd recommend pairing a dark top like this with light washed denim shorts - something with a destroyed finish and high waist.

To top it all off, I'd throw on a bracelet or two like the one pictured above from Aldo. The colours work well with the top and the gold goes with the sunglasses and shoe hardware. Avoid necklaces if possible since they're bound to smack you in the face when jumping to any songs and can get caught in your hair really easily. I speak from experience on both of those points (another sigh). Anyways, let me know what you think of my first festival outfit and fill me in on your summer music plans!

Bernanke says Fed's easy policy benefits world economy

WASHINGTON (Reuters) - Federal Reserve Chairman Ben Bernanke on Monday defended the central bank's aggressive easing of monetary policy, saying while it was aimed at bolstering the economic recovery, it was helping other countries as well.

The Fed's asset-purchase programs, aimed at keeping long-term borrowing costs down and spurring investment, have been criticized overseas for their adverse impact on emerging market currencies.

But the Fed chief, fresh from a grilling from Congress on the potential domestic risks of his quantitative easing measures, countered the rhetoric about "currency wars," though he did not use the term specifically.

In prepared remarks to a group of academics in London, Bernanke said the integrated nature of the global economy meant the whole world benefits from a sturdier outlook.

"Because stronger growth in each economy confers beneficial spillovers to trading partners, these policies are not ?beggar-thy-neighbor' but rather are positive-sum, ?enrich-thy-neighbor' actions," he said.

In response to a deep financial crisis and recession, and subsequent weak recovery, the Fed not only lowered overnight interest rates to effectively zero but bought more than $2.5 trillion in mortgage and Treasury securities.

Domestic critics say the central bank's vastly expanded balance sheet, now topping $3.1 trillion, risks future inflation. But Bernanke has noted that inflation is forecast to remain at or below the central bank's 2 percent target for the foreseeable future.

Economic growth, meanwhile, remains more of a question mark, particularly with the combination of sharp spending cuts at home and turbulence in European financial markets casting a pall over some better recent U.S. economic data.

Analysts expect gross domestic product will expand around 2 percent this year, while Fed officials see 2013 growth between 2.3 percent and 2.7 percent.

"The distinction between monetary policies aimed at domestic objectives and trade-diverting exchange rate devaluations and other protectionist measures is critical," Bernanke said.

(AP) ? Law enforcement officials praised the bravery and tenacity of a 9-year-old girl who crawled out of a mangled SUV at the bottom of a remote Southern California canyon and hiked nearly two miles to find help for her father, who was pinned in the driver's seat following a rollover crash.

Celia Renteria was sure her father was still alive when she climbed up the rocky embankment early Sunday, as temperatures dipped into the 40s, said California Highway Patrol Officer Gil Hernandez. When officers responded more than an hour and a half later, they found Alejandro Renteria, 35, was dead.

"She was very courageous, being able to walk through the dark, through bushes and very rough terrain to get help for her dad," Hernandez said. "Had she just waited there, we probably would not have found her until the next day."

The 2010 Ford Escape was launched about 200 feet down into the canyon along an isolated stretch of the Sierra Highway in the high desert of northern Los Angeles County at about 1 a.m. Sunday, the CHP said. The vehicle overturned several times.

Celia managed to extricate herself and walk through rugged terrain to a nearby home, but nobody answered the door, the CHP said. Then she hiked up the embankment and along the road to a commuter rail station in nearby Acton where she flagged down a passing motorist at about 2:30 a.m. Sunday.

In all, she trekked 1 1/2 to 2 miles.

"She walked quite a distance in a very, very threatening environment," CHP Sgt. Tom Lackey told KABC-TV. "It's very steep and it's brushy and there's also coyotes in the background."

A helicopter transported the girl to Children's Hospital Los Angeles. She was treated for minor injuries including bumps and bruises and a cut on her face.

"She's in good condition," Lyndsay Hutchison, a hospital spokeswoman, said Monday. She could not provide any details, citing privacy laws.

On video shot by the family in the hospital, the girl said she was cold and hurt, according to KCBS-TV. She told her family she was saddened to learn her father did not survive the crash.

A coroner's spokesman said Monday that Alejandro Renteria was a resident of the North Hollywood section of Los Angeles.

Television footage showed crews using a long tow cable to remove the severely damaged black SUV from the canyon.

The CHP was investigating whether alcohol played a role in the crash.

Acton is a small town tucked in the mountains between Los Angeles and the Mojave Desert.

My Mama is home from Michigan for a very short visit because of my brother?s condition. On a lighter note, it meant some new craft supplies for me. In my part of the world, we don?t have Michael?s, Jo-Ann?s, AC Moore or Hobby Lobby. Yes, it?s so sad that?s why I wish I will have my own craft store here in Cebu someday?I dream big :)

My loot came in this pretty bag from Jo-Ann?s. I liked the tape measure-like handle. Sorry for the instagrammed pictures. Still too tired and lazy to take out the heavy dslr.

What I usually do for craft supplies and products that aren?t found here in the Philippines, I? ask my Mama or brother buy it for me or purchase it online and ship it there in our place in Michigan and they send it to me or send it through balikbayan box (which takes forever!). I get mails regularly from Craft stores like Jo-ann?s or Michael?s and I use their coupons. These embossing folders and dies were on clearance at just $1.97 at Jo-Ann?s and the Cuttlebug was I think 50% off using the coupon at Michael?s. But I think you can use Michael?s coupon at Jo-Ann?s too.

Temple's Wyatt says thumb OK, ready for Indiana

DAYTON, Ohio (AP) ? Temple star guard Khalif Wyatt says his injured left thumb should not be a problem when the Owls play top-seeded Indiana in the NCAA tournament.

The Atlantic 10's player of the year got hurt in the second half of Friday's win over North Carolina State. He came out briefly to get his thumb taped and scored 31 points as the Owls advanced to face the Hoosiers. Wyatt said Saturday that X-rays were negative.

Owls coach Fran Dunphy expects Wyatt to be a "little tender" against Indiana on Sunday. Wyatt was checked by the team's doctor again Saturday, and Dunphy says the senior didn't have any trouble with his thumb during practice. Dunphy says the biggest concern is Wyatt's ability to catch the ball, but he doesn't think the injury "is a huge concern."

Judge: Aggregator of AP news can't have free ride

(AP) ? A federal judge ordered an Internet news clipping service to stop reselling stories from The Associated Press, saying the ability of news organizations to perform an "essential function of democracy" was jeopardized when a company is allowed to "free ride" on the costly work of others.

Media observers say the ruling against Meltwater U.S. Holdings Inc. and its Meltwater News Service, if upheld on appeal, could provide strong protection for the news industry as it struggles to survive in an Internet age.

U.S. District Judge Denise Cote rejected Meltwater's claims that its use of Web stories drawn from a scan of 162,000 news websites from more than 190 countries was a fair use of copyright-protected material.

"Through its use of AP content and refusal to pay a licensing fee, Meltwater has obtained an unfair commercial advantage in the marketplace and directly harmed the creator of expressive content protected by the Copyright Act," Cote said.

She said in a ruling released to lawyers in the case Wednesday and to the public on Thursday that investigating and writing about newsworthy events worldwide was expensive, and copyright laws permits the AP to earn money to pay for it.

"Permitting Meltwater to take the fruit of AP's labor for its own profit, without compensating AP, injures AP's ability to perform this essential function of democracy," Cote wrote.

In a statement, Meltwater called the ruling "at odds with a variety of prior decisions that have paved the way for today's Internet," and said it would appeal.

The judge noted that commercial Internet news clipping services like Meltwater perform an important function for their customers, but that "does not outweigh the strong public interest in the enforcement of the copyright laws or justify allowing Meltwater to free ride on the costly news gathering and coverage work performed by other organizations. Moreover, permitting Meltwater to avoid paying licensing fees gives it an unwarranted advantage over its competitors who do pay licensing fees."

Meltwater is a 12-year-old electronic news clipping service that helps its clients monitor how they are covered in the press. In its lawsuit, the AP alleged that Meltwater News had been pilfering current and past material from the AP and other news providers without paying licensing fees.

George Freeman, a media law expert in private practice at Jenner & Bloch, called the ruling "one of the most solid and comprehensive that we've had in this very important field."

Richard Stim, a San Francisco attorney and author of "Getting Permission: How to License & Clear Copyrighted Materials Online & Off," said the ruling is special because most lawsuits against news aggregators get settled out of court.

"It gets a case out there that makes it easier to push people into licensing agreements," he said. "That's its ultimate business function. That's why everybody settles. They don't want a case out there that gives (content owners) the ammunition to say, 'Last time we did it, we won in court.' "

Even on appeal, the case will provide an important precedent, he said.

"The appeal may or may not go the same way," Stim added. "For people who follow these things, there'll finally be some judicial decisions."

Dwayne Buttler, an expert on copyright law and an endowed chair at the University of Louisville, said Cote's ruling was likely not the final word on the matter, since various appellate courts are in disagreement on the subject.

He also cautioned that works that are more factual than creative are given less protection by U.S. copyright law, which does not protect facts or ideas from copying.

"Newspapers are on the borderline of protectability," Buttler said.

The judge rejected Meltwater's claims that it operates like a search engine.

"Meltwater News is an expensive subscription service that markets itself as a news clipping service, not as a publicly available tool to improve access to content across the Internet," she said. "Instead of driving subscribers to third-party websites, Meltwater News acts as a substitute for news sites operated or licensed by AP."

Cote praised the operation of legitimate search engines.

"These interests are complementary. The Internet would be far poorer if it were bereft of the reporting done by news organizations and both are enhanced by the accessibility the Internet provides to news gathered and delivered by news organizations," Cote said.

She also defended the creativity necessary to write the first paragraph of a story, known as a "lede," saying Meltwater "misses the mark" when it argues that ledes are teasers and not summaries of news.

"If anything, the observation emphasizes the creativity and therefore protected expression involved with writing a lede and the skill required to tweak a reader's interest," Cote said.

Meltwater said it believes Cote misapplied the fair-use doctrine.

"Meltwater is especially troubled by the implications of this decision for other search engines and services that have long relied on the fair-use principles for which Meltwater is fighting," the company said.

Jorn Lyseggen, Meltwater's founder and chief executive, said the company was considering options and looked forward to appealing to the 2nd U.S. Circuit Court of Appeals.

AP CEO Gary Pruitt said the ruling was important for the AP and "others in the news business who work so hard to provide high-quality original news reports on which the public relies."

"For years, all of us have been hearing that if it is free on the Internet, it is free for the taking. The judge in this case just rejected that argument," he said.

Earlier this year, The New York Times, USA Today publisher Gannett Co. Inc., the McClatchy Co. and Advance Publications Inc. said in court papers that their businesses would be jeopardized if Meltwater was permitted to continue as it had.

The publishers said the ability of companies to distribute their content without paying licensing fees jeopardized their websites and other digital businesses that generate revenue through advertising, subscriptions and licensing fees.

One of Meltwater's competitors, BurrellesLuce, joined in a friend-of-the-court brief to say that it operates at a disadvantage because it pays to license content that Meltwater takes for free.

The Electronic Frontier Foundation and Public Knowledge supported Meltwater in a court brief.

Caroline H. Little, president and CEO of the Newspaper Association of America in Arlington, Va., which joined an amicus brief on behalf of news companies, called the ruling a "monumental decision" that recognizes the value of newsgathering in society.

"The significant costs associated with global, national, regional and local newsgathering cannot be sustained if news organizations cannot protect the integrity of our publishing process," she said.

Meltwater was founded in 2001 in Oslo, Norway. According to the company's website, it has more than 800 employees working in 55 offices around the world.
