Key same-sex marriage ruling: Big impact on benefits ? Business ...
The U.S. Supreme Court last month agreed to hear a pair of cases challenging state and federal laws that define marriage to include only unions of a man and a woman.
Depending on how the court rules, married same-sex couples could become entitled to several federal benefits and legal protections, including the ability to obtain employer-sponsored medical benefits tax free. Look for oral arguments in the spring, with a ruling in June. (Windsor v. United States and Hollingsworth v. Perry)
The Supreme Court will hear other employment-related cases during its 2012-2013 term involving: the definition of ?supervisor? under Title VII, class-actions under the FLSA and how far ERISA-covered plans can go to get reimbursed when beneficiaries also collect damages from other plans.
